Terms of Use

These Terms of Use (“Terms”) are a binding agreement between you and Yulia Shkiter, an individual developer in Ukraine operating under the MatchOracle name (“MatchOracle,” “we,” “us,” or “our”). They govern the MatchOracle iOS application, website, backend, content, and related support (together, the “Service”).
By downloading, accessing, purchasing, or using the Service, you confirm that you have read and accept these Terms and the Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility and Apple Terms
You must be legally capable of entering this agreement. If you are below the age of legal majority where you live, a parent or legal guardian must authorize your use and is responsible for it.
For the licensed iOS application, these Terms supplement Apple’s applicable App Store terms and the Apple Standard Licensed Application End User License Agreement (“Apple EULA”). If a provision conflicts with mandatory Apple licensing terms, the Apple terms control for that issue. Apple is not responsible for operating, supporting, or warranting MatchOracle except as Apple’s terms expressly require.
2. Limited License
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the app on Apple-branded devices you own or control as permitted by Apple’s usage rules.
No ownership is transferred. Except where applicable law expressly permits it, you may not copy, reproduce, distribute, sell, rent, sublicense, scrape, extract, frame, mirror, modify, create derivative works from, decompile, reverse engineer, bypass, or commercially exploit the Service or its content.
3. About MatchOracle
MatchOracle provides football fixtures, live match context, statistics, team form, performance information, and prediction-style insights for informational and entertainment purposes only.
4. No Betting or Gambling Services
MatchOracle does not accept or facilitate wagers, operate as a bookmaker, sportsbook, casino, gambling platform, or real-money gaming service, handle deposits or withdrawals, pay winnings, or provide bookmaker links as a Service feature.
Nothing in the Service is financial, investment, legal, professional, gambling, or betting advice. You are solely responsible for your decisions and for complying with laws applicable to you. You must not rely on the Service to stake money, incur debt, or make any financial decision.
5. Predictions, Statistics, and No Guaranteed Outcomes
Prediction-style insights are generated from available football data, statistical indicators, team form, fixture context, automated rules, and other inputs. Football is inherently uncertain.
No prediction, confidence percentage, past performance, score, statistic, notification, or other content guarantees or implies a future result. Past performance is not evidence that future insights will be accurate. You assume all risk arising from how you interpret or use the content.
We do not warrant that fixtures, scores, statuses, statistics, teams, competitions, translations, insights, performance records, or other information are accurate, complete, current, or free from omissions. Data can be delayed, corrected, canceled, abandoned, restated, or unavailable.
6. Third-Party Data and Infrastructure
The Service depends on Apple, football-data providers, hosting, caching, network, and infrastructure services that we do not control. To the maximum extent permitted by law, we are not responsible for provider errors, outages, delays, incomplete data, network failures, device settings, iOS behavior, or other events outside our reasonable control.
7. Free Access
We may provide limited free access, currently one user-selected match with its available predictions per UTC calendar day. The selection is final for that day, unused access does not carry forward, and availability may depend on match and data status. Previously unlocked or completed-match content may remain accessible at our discretion.
We may change, limit, suspend, or discontinue free access, eligibility, reset timing, or content at any time, provided that changes do not unlawfully remove already purchased rights.
8. Premium Auto-Renewable Subscriptions
MatchOracle Premium unlocks available future predictions while an Apple-verified entitlement is active. Weekly, monthly, and six-month plans currently provide the same Premium features and differ by billing period and localized price.
The definitive product name, duration, price, currency, taxes, and any eligible offer are shown by Apple before confirmation. No free trial applies unless Apple expressly displays one on the purchase screen. We may change future pricing or plans through App Store Connect; Apple will provide any notice or consent process required for existing subscribers.
Payment is charged to your Apple Account at confirmation. Each subscription renews automatically for the same duration unless canceled. Apple may charge renewal shortly before the next period according to Apple’s billing rules.
9. Cancellation, Restore, Billing, and Refunds
You can manage or cancel Premium through Manage Subscription in the app or Apple Account subscription settings. Cancel before Apple processes the next renewal. Cancellation stops future renewals but normally does not create a prorated refund; access usually continues through the paid period unless Apple refunds or revokes the transaction.
Deleting the app, stopping use, or requesting deletion of MatchOracle backend data does not cancel an Apple subscription.
Restore Purchases attempts to reconnect an active entitlement available to the same Apple Account. Restoration can depend on Apple availability, StoreKit status, network access, and successful cryptographic verification.
Apple controls billing, payment methods, tax collection, renewal charging, and refund decisions. Submit refund requests at reportaproblem.apple.com. Except where Apple or mandatory law provides otherwise, fees are non-refundable and no credits are issued for partially used periods. A refund, chargeback, or revocation may immediately remove Premium access.

10. Access Verification and Security
Premium requires an active Apple-signed entitlement. We may verify transaction identifiers, product, bundle, app, expiration, renewal, refund, revocation, and anonymous installation information. We may deny or remove access when verification fails, a transaction expires or is revoked, data is inconsistent, or we reasonably suspect fraud, replay, manipulation, unauthorized sharing, or circumvention.
You must not share signed transaction payloads, attempt to transfer an entitlement outside Apple-supported mechanisms, manipulate installation identifiers, bypass access controls, or falsely obtain free or Premium content.
11. Acceptable Use
You agree to use MatchOracle lawfully and responsibly.
You must not:
- use the Service for unlawful, fraudulent, abusive, deceptive, or harmful purposes;
- interfere with, overload, attack, probe, or disrupt the app, website, backend, providers, or other users;
- use bots, scraping, bulk extraction, automation, or unauthorized APIs to collect content or data;
- bypass rate limits, paywalls, subscription checks, free-access rules, authentication, or other protections;
- introduce malicious code, impersonate another person, or misrepresent transaction or device information;
- use MatchOracle content to build, train, benchmark, or operate a competing product without written permission;
- infringe intellectual-property, privacy, or other rights.
12. Suspension and Termination
We may investigate violations and suspend, restrict, or terminate access to protect users, providers, intellectual property, security, or the Service; comply with law; respond to fraud or abuse; or enforce these Terms. Where reasonably possible and legally required, we will provide notice. Termination does not create a refund right and does not itself cancel an Apple subscription.
13. Intellectual Property and Feedback
The MatchOracle name, marks, software, interface, design, original text, prediction presentation, compilation, and other original materials are owned by or licensed to us and protected by applicable law. Football data, club and competition names, logos, Apple marks, and other third-party materials belong to their respective owners.
If you voluntarily submit feedback or suggestions, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use and incorporate them without compensation or attribution, to the extent permitted by law. This does not transfer ownership of your personal support content.
14. Changes and Availability
We may patch, update, redesign, add, remove, suspend, or discontinue features, content, supported competitions, languages, countries, devices, or the Service. We do not guarantee uninterrupted, secure, or error-free operation. We will not knowingly deprive you of mandatory statutory rights or already-paid access without an available legal remedy.
15. Disclaimer of Warranties
To the maximum extent permitted by law, the Service and all content are provided “as is” and “as available”, with all faults and without warranties of accuracy, merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, security, or results. Some jurisdictions do not allow particular disclaimers, so they apply only to the lawful extent.
16. Limitation of Liability
To the maximum extent permitted by law, MatchOracle, its operator, contractors, licensors, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, data, opportunities, goodwill, or business; financial or wagering losses; device or account issues; or losses arising from predictions, inaccurate or delayed football data, notifications, outages, unauthorized access, third-party services, or inability to use the Service.
To the maximum extent permitted by law, aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid for MatchOracle Premium during the 12 months before the event giving rise to liability or (b) USD 50.
Nothing in these Terms excludes liability that cannot lawfully be excluded or limited, including liability for fraud, willful misconduct, gross negligence where applicable, or death or personal injury caused by negligence where such exclusion is prohibited.
17. Indemnity
To the extent permitted by law, you will indemnify and hold MatchOracle and its operator harmless from third-party claims, losses, and reasonable costs arising from your unlawful use, deliberate misuse, infringement of third-party rights, transaction manipulation, or material breach of these Terms. This clause does not apply to liability caused by us or where consumer law prohibits it.
18. Mandatory Consumer Rights
Nothing in these Terms waives non-excludable consumer rights. If mandatory law in your country provides stronger cancellation, refund, warranty, jurisdiction, or liability rights, that law controls to the required extent. Apple’s refund and billing procedures remain subject to applicable law.
19. Force Majeure
We are not responsible for delay or failure caused by events beyond reasonable control, including war, invasion, terrorism, civil disorder, government action, sanctions, power or internet failures, cyberattacks, labor disputes, natural disasters, epidemics, provider failures, sports-data outages, or Apple service interruptions.
20. Governing Law and Disputes
These Terms are governed by the laws of Ukraine, excluding conflict-of-law rules, except that mandatory consumer protections of your habitual residence continue to apply. Courts of Ukraine have non-exclusive jurisdiction, and you may bring claims in any court that mandatory consumer law permits.
Before filing a claim, please send a concise notice to matchoracleapp@gmail.com and allow 30 days for an informal resolution, unless urgent relief, a limitation period, or mandatory law makes that impractical. This does not restrict statutory complaint or court rights.
21. General
These Terms, the Privacy Policy, Apple’s applicable terms, and information shown at purchase form the agreement for the Service. If a provision is unenforceable, it will be limited to the minimum necessary and the remainder will continue. Failure to enforce a term is not a waiver. You may not assign your rights without consent; we may assign the agreement as part of a lawful business transfer. Headings are for convenience. Provisions that by nature should survive termination—including intellectual property, disclaimers, liability, indemnity, disputes, and general terms—will survive.
22. Changes to These Terms
We may update these Terms for legal, security, provider, feature, or operational reasons. The effective date identifies the current version. Where required, material changes will be communicated through the app or another reasonable channel. Continued use after the new effective date constitutes acceptance, but changes do not retroactively remove accrued mandatory rights.
